The French <strong>Ministry of<\/strong> Health is considering the use of <strong>cameras<\/strong> equipped with<strong>artificial intelligence<\/strong>, capable of assessing the age of customers in real time. But the <strong>CNIL<\/strong>, guardian of the <strong>data<\/strong> <strong>code<\/strong>, remains cautious. However, <strong>manual controls<\/strong> are no longer enough. The parallel <strong>market<\/strong>, false papers, deception&#8230; a <strong>survey<\/strong> shows that 20 to 30% of cigarette purchases in France involve minors. The arrival of facial <strong>recognition<\/strong> and artificial intelligence <strong>systems<\/strong> promises a more reliable detection <strong>rate<\/strong>, without adding staff or increasing <strong>fines<\/strong>.   <\/p>\n\n<h2 class=\"wp-block-heading\">Security, data, privacy: where does CNIL stand?<\/h2>\n\n<p class=\"wp-block-paragraph\">The <strong>French Data Protection Authority (CNIL<\/strong> ) has published a mixed <strong>report<\/strong>. It recognizes the advantages of this <strong>technological process<\/strong>, but is concerned about excessive use of <strong>personal data<\/strong>.<br\/>It points out that these <strong>cameras<\/strong> cannot be used without legal control: <strong>operation<\/strong> must be transparent, <strong>storage<\/strong> limited to what is strictly necessary, and everything must comply with the <strong>legal framework<\/strong>. <strong>National jurisdictions<\/strong> may require an <strong>opinion<\/strong> or prior <strong>authorization<\/strong>.  <\/p>\n\n<div style=\"height:48px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">Tobacconists, mayors, police: who manages what?<\/h2>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Installing these cameras in a <strong>public place<\/strong>, such as a tobacconist&#8217;s, is an <strong>exercise shared<\/strong> between the operating <strong>companies<\/strong>, the <strong>police<\/strong> and municipal <strong>services<\/strong>. Using feature recognition (forehead, eyes, chin), the tool estimates an approximate age. If the person appears to be a minor, a message warns <strong>staff<\/strong>: &#8220;Purchase forbidden, please show ID&#8221;.<br\/><strong>Total<\/strong> purchases are tracked anonymously. No images are saved, and no personal information is <strong>collected<\/strong>. A subtle <strong>balance<\/strong> between health <strong>safety<\/strong> and respect for privacy.    <\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">What does justice and public law have to say?<\/h2>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">Experiments have been carried out in several <strong>countries<\/strong>. In the <strong>USA<\/strong>, some jurisdictions have banned facial recognition, while others authorize it subject to conditions. Without this <strong>relationship of trust<\/strong>, all technological progress risks being blocked. The stakes are twofold: to protect minors and to preserve the rights of everyone.  <\/p>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\">Conclusion: a challenge for society<\/h2>\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p class=\"wp-block-paragraph\">The widespread use of <strong>augmented cameras<\/strong> in tobacco shops poses a real French dilemma: between giving priority to <strong>public health<\/strong>, modernizing the tobacco <strong>market<\/strong>, and guaranteeing individual freedoms. The <strong>framework<\/strong> already exists: <strong>law<\/strong>, <strong>CNIL<\/strong>, courts, municipal <strong>services<\/strong> and <strong>police<\/strong>. All that remains is to fine-tune the balance between <strong>security<\/strong> and <strong>respect for citizens<\/strong>.  <\/p>\n\n<p class=\"wp-block-paragraph\">In a world where digital technology is becoming increasingly important, these <strong>systems<\/strong> could well become the norm in the fight against youth smoking. That&#8217;s provided that every <strong>position<\/strong> is taken: those of <strong>companies<\/strong>,<strong>administration<\/strong>, <strong>government<\/strong>, and every citizen.
