Rights and prohibitions in the workplace"},"content":{"rendered":"\n<p><strong>Vaping at work<\/strong> has become a key issue in <strong>companies<\/strong>, particularly with the rise of <strong>electronic cigarettes<\/strong> as an alternative to tobacco. But <strong>employees<\/strong> &#8216; <strong>rights<\/strong> in this area are not as clear-cut as one might think. Between <strong>prohibitions<\/strong>, <strong>Labor Code<\/strong> rules and <strong>employers<\/strong>&#8216; obligations, the <strong>regulations governing vaping<\/strong> in the workplace need to be clarified. <strong>Where<\/strong> is <strong>vaping<\/strong> permitted? What are the <strong>penalties<\/strong> for non-compliance <strong>?<\/strong>      Are there <strong>reserved areas in<\/strong>professional <strong>establishments<\/strong> for <strong>electronic cigarette<\/strong> <strong>smokers<\/strong>? The <strong>law<\/strong> strictly regulates<strong>smoking<\/strong> practices, particularly in certain <strong>indoor areas<\/strong> accessible to the <strong>public<\/strong>. <\/p>\n\n<p><\/p>\n\n<div style=\"height:26px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h3 class=\"wp-block-heading\"><strong>Vaping banned in certain workplaces<\/strong><\/h3>\n\n<p>Since the <strong>Health Act<\/strong> of 2016, reinforced by a <strong>decree<\/strong> of April 25, 2017, the<strong>ban on<\/strong> <strong>vaping<\/strong> in certain <strong>workplaces<\/strong> has been clearly enshrined in the <strong>Labor Code<\/strong>. This <strong>ban<\/strong> concerns <strong>covered<\/strong> <strong>offices<\/strong> and <strong>premisespublic<\/strong> where several <strong>employees<\/strong> work in <strong>collective spaces<\/strong>. <\/p>\n\n<div style=\"height:28px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p><strong>Vaping<\/strong> is therefore prohibited:<\/p>\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<ul class=\"wp-block-list\">\n<li><strong>Group offices<\/strong>, <strong>meeting rooms<\/strong> and <strong>open spaces<\/strong>.<\/li>\n\n\n\n<li>Enclosed <strong>public places<\/strong> such as <strong>establishments<\/strong> open to the <strong>public<\/strong>.<\/li>\n\n\n\n<li><strong>Service<\/strong> and customer reception <strong>areas<\/strong> in <strong>companies<\/strong>.<\/li>\n<\/ul>\n\n<div style=\"height:19px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>This <strong>ban<\/strong> was <strong>introduced<\/strong> to protect <strong>employees<\/strong> from <strong>passive smoking<\/strong> and ensure a healthy <strong>working<\/strong> environment. <strong>Employers<\/strong> are required to inform their teams of these <strong>rules<\/strong>, failing which they will be liable to <strong>prosecution<\/strong>. <\/p>\n\n<div style=\"height:55px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<figure class=\"wp-block-image alignright size-full is-resized\"><img decoding=\"async\" width=\"259\" height=\"194\" src=\"https:\/\/www.mylasertabac.com\/wp-content\/uploads\/2025\/03\/emplacement-reserve-pour-les-fumeurs.jpeg\" alt=\"\" class=\"wp-image-5343\" style=\"width:379px;height:auto\"\/><\/figure>\n\n<h3 class=\"wp-block-heading\"><strong>Where can I legally vape at work?<\/strong><\/h3>\n\n<p>Despite these <strong>restrictions<\/strong>, there are some <strong>reserved areas<\/strong> where <strong>employees<\/strong> can <strong>smoke<\/strong>. Depending on the <strong>employment<\/strong> <strong>contract<\/strong> and the<strong>company<\/strong>&#8216;s <strong>internal regulations<\/strong>, it is possible to set up <strong>reserved areas<\/strong>. <\/p>\n\n<p><strong>Authorized locations<\/strong> are generally :<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Individual offices<\/strong>, unless specifically <strong>prohibited<\/strong> by the<strong>employer<\/strong>.<\/li>\n\n\n\n<li><strong>Places reserved for<\/strong> <strong>smokers<\/strong>, located<strong>outside<\/strong> <strong>establishments<\/strong>.<\/li>\n\n\n\n<li><strong>Rooms<\/strong> for breaks and relaxation, if not accessible to the <strong>public<\/strong>.<\/li>\n<\/ul>\n\n<p>In these <strong>places<\/strong>, it&#8217;s essential that <strong>electronic cigarette<\/strong><strong>use<\/strong> complies with <strong>safety<\/strong> instructions and<strong>company<\/strong> <strong>regulations<\/strong>.<\/p>\n\n<div style=\"height:55px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<h2 class=\"wp-block-heading\"><strong>What are the penalties for non-compliance?<\/strong><\/h2>\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Failure to comply with the rules on <strong>vaping<\/strong> at <strong>work<\/strong> can result in <strong>penalties<\/strong> for both <strong>employees<\/strong> and <strong>employers<\/strong>. If the<strong>employer<\/strong> fails to clearly display the<strong>ban<\/strong>, he or she may be liable to a fine of up to <strong>750 euros<\/strong>, which represents a considerable legal risk. <\/p>\n\n<p>In addition, <strong>employers<\/strong> must ensure that their <strong>internal regulations<\/strong> include restrictions on <strong>vaping<\/strong>, and clearly inform <strong>employees<\/strong> of <strong>areas<\/strong> where <strong>smoking<\/strong> or the use of <strong>electronic cigarettes<\/strong> is prohibited. Negligence on this point may be considered a <strong>safety<\/strong> fault, engaging the employer&#8217;s liability in the event of litigation. It&#8217;s important for <strong>companies<\/strong> to take account of <strong>employees<\/strong> &#8216; needs, while complying with <strong>current regulations<\/strong>. <\/p>\n\n<p>Some <strong>companies<\/strong> choose to support their <strong>employees<\/strong> in quitting <strong>smoking<\/strong>, offering solutions such as <strong>training<\/strong> on the risks associated with <strong>cigarettes<\/strong>, or supporting alternative methods such as <strong>anti-smoking laser<\/strong>. Some impose <strong>prohibitions<\/strong> similar to those in the <strong>French Labor Code<\/strong>, while others leave more freedom to <strong>companies<\/strong> and <strong>employers<\/strong>. Some <strong>establishments<\/strong> require <strong>reserved areas<\/strong> for <strong>e-cigarette<\/strong> users, in the same way as for <strong>smokers<\/strong>.  <\/p>\n\n<p>In <strong>Spain<\/strong>, the<strong>ban on<\/strong> <strong>vaping<\/strong> is similar to that on <strong>passive smoking<\/strong>. The <strong>law<\/strong> prohibits the<strong>use of<\/strong> <strong>e-cigarettes<\/strong> in all <strong>offices<\/strong>, <strong>covered areas<\/strong> of <strong>establishments<\/strong> open to the <strong>public<\/strong>, and <strong>public transport services<\/strong>. However, some <strong>companies<\/strong> offer specific areas for <strong>employees<\/strong> wishing to <strong>vape<\/strong>, under certain conditions.  <\/p>\n\n<p>In the <strong>UK<\/strong>, regulations are even stricter. <strong>British law<\/strong> imposes an almost total <strong>ban<\/strong> on <strong>vaping<\/strong> in all <strong>public places<\/strong>, including private <strong>offices<\/strong> and <strong>workplaces<\/strong>. <strong>Companies<\/strong> are obliged to put in <strong>place<\/strong> precise rules on <strong>vaping<\/strong>, with mandatory signage and <strong>penalties<\/strong> for non-compliance.  <\/p>\n\n<p>Some <strong>employment lawyers<\/strong> point out that this diversity of <strong>regulations<\/strong> can pose a problem for mobile workers or <strong>international companies<\/strong>. Indeed, an expatriate <strong>employee<\/strong> or <strong>business<\/strong> executive may be confronted with totally different rules from one country to another. Some MEPs are calling for a single set of regulations that would impose clear rules on the<strong>use of<\/strong> <strong>e-cigarettes<\/strong> in the <strong>workplace<\/strong>. This would avoid <strong>confusion and<\/strong>guarantee better protection for <strong>employees<\/strong>, while ensuring compliance with the <strong>obligations<\/strong> of each <strong>employer<\/strong>.  <\/p>\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Current debates focus on several aspects:<\/p>\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<ul class=\"wp-block-list\">\n<li>Should <strong>vaping<\/strong> be brought into line with <strong>passive smoking<\/strong> rules?<\/li>\n\n\n\n<li>Should the<strong>ban<\/strong> be extended to <strong>individual offices<\/strong>, or left to the discretion of <strong>companies<\/strong>?<\/li>\n\n\n\n<li>How can we balance <strong>employee<\/strong> <strong>rights<\/strong> with <strong>public health<\/strong> imperatives?<\/li>\n<\/ul>\n\n<div style=\"height:23px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n<p>Some experts believe that the <strong>introduction<\/strong> of a European directive would enhance <strong>legal certainty<\/strong> for <strong>companies<\/strong> and simplify <strong>employers<\/strong> &#8216; <strong>vaping<\/strong> <strong>obligations<\/strong>.
